Graham won't face trial
A Smith County grand jury in May no-billed Graham - meaning he wasn't indicted for the shooting and, and he won't stand trail. Graham contended all along he shot the man in selfdefense. Graham came home a little after noon on Feb. 18, according to police reports, and found an unfamiliar car in his driveway and his door kicked in. The suspected burglar, Hiram Josha Chambers, ran outside of Graham's house with two bags. Graham, who had a firearm in his possession, yelled at the 33-year-old Tyler man and told him to drop the bags and get on the ground while he called the police. Smith County sheriff's department officials said that Chambers didn't heed Graham and tried to escape. Chambers tried to run over Graham, at which time Gram shot and killed the suspect with a single shot. On Wednesday, District Attorney Matt Bingham said a full presentation of the case was made to the grand jurors, including testimony from eye witnesses and Massad Ayoob, an expert on the use of deadly scene and reviewed the case. Bingham said the grand jury failed to find probable cause that any offense had been committed. Defense attorney Brett Harrison, who represented Graham, said grand jurors found his client acted appropriately under the circumstances and it was a justified shooting. Chambers had been paroled July 25, 2006, after serving prison time for burglary of a habitation. When investigators arrived at Graham's home they discovered loaded guns in a sack on the front seat of Chambers' car. |
